1 Acceptance The following terms and conditions administer your use of countingjobs.com.au website ("the Website"). By registering with CountingJobs you are acknowledging you are bound by these terms or provisions. You should refer to these terms and conditions periodically as CountingJobs may change them without notice. If at anytime you disagree with any of the terms and conditions you must cease using any services the Website has to offer. In these terms and conditions, "CountingJobs Services" means any service offered by the Website for Advertisers or Candidates wishing to apply for jobs. CountingJobs Services requires either the Advertiser or Candidate to register with the Website. By agreeing to our terms and condition you also understand and accept our privacy policy which can be read here 1.1 Intended Use and Services Offered The Website is intended for use by "Advertisers" and "Candidates". "Candidates"
are individual persons using the CountingJobs Services to find job vacancies,
subject to the conditions set out below. "Advertisers" may be a company or an
individual/partnership looking to advertise on CountingJobs or use any other
service provided by CountingJobs. Advertisers are permitted to utilise the
following CountingJobs Services, subject to the conditions listed in section
1.2: Candidates must register before using the CountingJobs Services to apply for
jobs. Candidates do not have register to use other service provided by
CountingJobs. Candidates are permitted to use utilise the following services,

Advertisers must not use the CountingJobs Services or use and access the Website other than as expressly permitted in section 1.1 above. Advertisers acknowledge and agree that CountingJobs bears no liability for any loss or damage suffered or incurred by Candidate or Advertiser, arising from the use of any of the CountingJobs Services or the Website. Advertisers indemnify CountingJobs from all costs, claims, expenses or demands incurred by or made against CountingJobs due to any breach by the indemnifier of these terms and conditions, including but not limited any use of the services not expressly permitted in section 1.1 or the provision of any information to the website which is false, inaccurate, misleading or in contravention of any law. COUNTINGJOBS BEARS NO RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF CONTENT POSTED ON THE WEBSITE IN RELATION TO JOBS ADVERTISED. Advertiser acknowledges and agrees that CountingJobs does not endorse or recommend any Candidate or make any representations as to the quality, qualifications, suitability or any other attribute of a Candidate. Advertiser must ensure that all information supplied to CountingJobs (including all job postings) is accurate, complete and up to date. CountingJobs reserves the right to take down a job placed on the website. CountingJobs will endeavor to contact the Advertiser if this happens. Advertiser acknowledges that CountingJobs may edit any job posting or company profile template (includes content and template) without the consent of the Advertiser. CountingJobs will make every effort to contact the Advertiser if changes are made (or will be made) to any job posting or company profile. CountingJobs accepts no liability for any loss or damage to the Advertiser or to a Candidate arising from changes made to any information on the Website by CountingJobs. CountingJobs does not make any representation or give any warranty in relation

To the extent that any warranty cannot be excluded by law, CountingJobs' liability to any Advertiser is limited to the re-supply of the CountingJobs Services or, where such supply is not possible, the cost of supply of such services. CountingJobs takes no responsibility for the misuse of login details (username and password) of Advertisers. It is the Advertiser's responsibility to keep their login details confidential. Advertisers must not misinform people searching for employment as to the jobs availability and nature, terms or conditions or, any other matter relating to the opportunity of employment being offered. In doing so, Advertisers agree to meet the terms of section 53B of the Trade Practices Act 1974. Advertisers agree to use the CountingJobs Services in accordance with the Privacy Policy defined by CountingJobs. CountingJobs is not liable for any loss, damages or liabilities arising from the failure of the internet, World Wide Web, or any telecommunications infrastructure. CountingJobs will endeavour to rectify any failure to "the Website" in the fastest possible time. Advertisers must pay all Invoice amounts owing to CountingJobs within 14 days of
the agreed day of charge.
1.3 Candidates Terms & Conditions Candidate must not use the CountingJobs Services or use and access the Website other than as expressly permitted in section 1.1 above. Candidates acknowledge and agree that CountingJobs bears no liability for any loss or damage suffered or incurred by the Candidate, arising from the use of any of the CountingJobs Services or the Website. Candidates indemnify CountingJobs from all costs, claims, expenses or demands incurred by or made against CountingJobs due to any breach by the indemnifier of these terms and conditions, including but not limited any use of the services not expressly permitted in section 1.1 or the provision of any information to the website which is false, inaccurate, misleading or in contravention of any law. Candidate acknowledges that it uses the CountingJobs Services to submit all job applications and accepts any offer of employment advertised on the Website upon making its own enquiries as to the suitability of the company offering employment and the position advertised.
